In my state they have capital murder and murder. Capital murder is a murder that is committed at the same time as another felony ie rape, armed robbery. This conviction carries either life without parole or the death penalty. murder means you intended to kill the other person. manslaughter is you didn't have the intent to kill. This has a 20 year maximum.First Degree Murder:
first degree murder n. although it varies from state to state, it is generally a killing which is deliberate and premeditated (planned, after lying in wait, by poison or as part of a scheme), in conjunction with felonies such as rape, burglary, arson, involving multiple deaths, the killing of certain types of people (such as a child, a police officer, a prison guard, a fellow prisoner), or with certain weapons, particularly a gun. The specific criteria for first degree murder are established by statute in each state and by the United States Code in federal prosecutions. It is distinguished from second degree murder in which premeditation is usually absent, and from manslaughter which lacks premeditation and suggests that at most there was intent to harm rather than to kill
Second Degree Murder:
second degree murder n. a non-premeditated killing, resulting from an assault in which death of the victim was a distinct possibility. Second degree murder is different from First Degree Murder which is a premeditated, intentional killing, or results from a vicious crime such as arson, rape, or armed robbery. Exact distinctions on degree vary by state.
In my state there is no attempted murder charge. Just aggravated assault. they do have a conspiracy to commit murder if you pay a hit man. i think that carries the same penalty as murder even if the crime isn't carried out.
I've sat through a lot of murder trials and the pictures, 911 calls, evidence and testimony is so gruesome. It's hard for me so I feel sorry for the families to have to sit listening to how their loved ones weret tortured or how their brains were splattered everywhere. No lie. I covered a case where a teen raped a woman with a pool stick before shooting her to death. Then most of the time the defense teams come up with lame you'd have to be an idiot to believe excuses for their clients or try to make the victim look bad. One witness said she saw a man (who had tried to rape her) wrestling on the ground with two police officers, she ran in the house to call for help and heard two shots. The defense was like well you didn't see what happened so how do you know someone else didn't shoot the officers. Really?? This was out in the country. No one else was out there and two cops are dead. Duh? I couldn't be a criminal defense attorney and defend some of the POS that I see in court.
