I'm so totally disgusted for you. By far I'm no medical expert, nor detective/investigator, but the following thoughts are glaringly obvious to me:

If she did not run the stop sign, wouldn't that mean she would have then obeyed the sign and come to a complete stop?

If she indeed blacked out while stopped @ the stop sign, then wouldn't her body go limp? And if she was unconscious at the time, wouldn't her muscles be relaxed?

And if she went limp, then wouldn't the pressure of her foot slip lessen on the brake pedal (or completely slip off) that she was *allegedly* pressing? If that was the case then wouldn't her car only accelerate/coast at whatever the idle is set to? (I highly doubt that her car, traveling at its idle, could gain enough momentum do that much damage.)

So if those points are that apparent to a layperson like me, why aren't they to law enforcement???

I pray you get the justice you so obviously deserve.

What is your attorney saying?? Has your attorney advised you on how you should testify? Aside from your furniture, is your attorney requesting other damages from the driver's insurance company?

It is truly a miracle that you and your kids escaped from this. So glad you're OK!

I fired my attorney, he was shady. So for now I'm representing myself until it's absolutely necessary to seek more legal counsel.

I'm not too worried about it,I'm just kind of disgusted she's trying to dispute the ticket itself. But,I do have a ton of pictures to verify it was indeed her who ran the sign AND drove through my home.

I'm trying to deal with the insurance company myself as far as the injury settlement is concerned, and just praying God handles it justly. At this point I'm so tired of dealing with these people it's ridiculous.

My lawyer made it pretty clear he basically thought of me as a single black mom out for money for no reason. That's why he got fired. Not to mention he was all around shady in general.

I'm so over it!

ETA: and I thought the same thing about her passing out...why would her passing out make her foot press down even more on the gas? She seemed to gain majority of her speed after blowing through the stop sign,and I would have assumed a passed out body wouldn't have the power to put that much pressure on a gas petal

Get an atty! I've been burned quite a few times believing that the evidence will speak for itself. It doesn't always work that way. Be careful!

And I'm glad you all are OK. How terrifying! I know as a mother you probably want to whoop her ass!

I'm going to ask around for some things for you cause this sh*t is totally ridiculous, that lawyer needs to be disbarred and that cop needs a foot up his ass.

And that woman?? Should have been locked the hell up on spot!!!

How the f**K can you lie and make up some sh*t about someone running into your damn house, damn near killing you and your kids!!!!!!!!!

Not sure of your financial situation, but have you contacted Legal Aid? What about another lawyer from the phone book? You can always check online reviews.

Is the driver related to someone powerful? Unless you just live in a very small town or corrupt area, the driver should have been charged with destruction of property. Even if it were because of passing out, which I don't believe, she still damaged property and drove recklessly. At the very least, you could bring it to the news to shame everyone involved. The station would love those pictures, and the fact that this lady doesn't seem to have any consequences for her actions.

I am sending good thoughts your way. I hope things get easier because your family and you don't deserve this.

Trust me,I was telling people to get her ass out of the car because I was gonna whoop that ass! I was scared, traumatized etc!!! I couldn't even tell the fireman my apartment number I was so out of it.

The cop was incredibly rude,and yelling at me telling me I needed to calm down because it "isn't that serious, and your kids are obviously ok ". WHO THE HELL SAYS THAT?

The court date is approaching! I'm ready to get this over with. I almost wish I could video tape the whole thing to see her reaction to me telling the real story, and her trying to say she did not indeed run the stop sign.

I'm still dealing with the injury part of the settlement, so hopefully that's handled within the next week too. I'm tired of faxing paperwork from the hospital visits!

Anyway, I'll update when the day is actually here.

Sitting in court now! Will update ASAP.

UPDATE: the lady paid the ticket when she saw me enter the courtroom!!! My name wasn't called and I was told to go talk to the bailiffs, who informed me the lady had* just* paid the ticket! So basically I wasted gas,could've slept in,and saved my mom the trouble of watching my kids since she just had flown in last night from a trip and was exhausted!

Oh well,she got hers!

I' haven't read anywhere here (just skimmed quickly) that you're filing against her. If so, just ignore me.. but if not....

You have a huge law suit against her. You should be able to easily receive 50- 100,000 plus for the pain, suffering, loss of work, damages and psychological issues you and your family are suffering.

Get yourself a really good lawyer. He will easily take the case with no money up front, and will take 30% of the proceeds.

You will win if you are organized. You and your kids deserve the financial compensation for this mess which was 100% HER FAULT. (blackout or not!!!!)

Hey thanks for asking!! Everything panned out alright, actually. The insurance company still tried to screw me over, so I had to file a formal complaint with the board of insurance. But, apparently the board is *very* firm on their policy with complaints, and immediately handled my case the same week.

I'm just glad to be done with the whole thing. It was awful.

One thing that *really* bothered me was looking at the hospital records from the day of the accident. They put in the report that "patient was avidly texting on phone upon entering triage room, yet complained right hand was broken". That made me so angry. I know for a fact I was texting upon entering, but it was with my left hand because my right hand was so swollen I couldn't even shift my car from park to drive without screaming. I couldn't understand why a hospital would purposely try to make a patient look bad....
