Car accident, my minor son and a subpoena.
 

Ok so my 17 year old, who is on a learner's permit, was in a car accident that was not his fault at all. The other guy was given a ticket for "failure to yield". Now my kid has received a subpoena in the mail saying he's called as a witness for "the city vs. the dude that hit us." Whats going on? Is he fighting the ticket and saying the accident was my boy's fault or is the city suing him? So far his insurance company hasn't even asked to speak to my son since I was the licensed driver in the car. Just confused.

Sounds like the other guy is fighting the ticket. The ticket is a separate issue from the accident.

The other dude's being a tool and trying to fight the ticket. Which is dumb on his part especially if his failure to yield led to a collision. Jerk.

He's probably trying to fight it, to get reduced.
I'd do it too, even if it was my fault. It reduces it a little, unless he's a tool to the judge.

Do I really have to pull my son out of school to go the court? Yes, I know NOTHING about this kind of thing.

If your so has been subpoenaed then yes, you have to pull him out of school.

Sigh... So annoying.

Yeah, that's the point of a subpoena. :laughing4: Sorry for laughing, but it says right there on the subpoena that it's not optional.

I know. I haven't actually seen it though. It was sent to his dad's house and he called me and told me about it. I just wish people could accept responsibility for their actions and stop trying to blame their **** in everybody else.

i get you're angry but maybe in his eyes, your son was somehow in the wrong in driving.
I don't see any thing wrong with him wanting to go to court, he has a right to. Even if he was wrong, and since he was wrong, theres no point to be upset.


I wouldn't really stress over it. It's really boring. I've done it in high school because of an old lady who was blind. (no she actually could not see, why was she driving...).

It also doesn't take too long, it took me about an hour being in the court room.

No I was with him. He only has a learner's permit. I got one too. I guess his perfect attendance record is out the window, lol.

does it bother his record if he's taken out of school and once it's done put back in. School's like 8 hours, he doesn't have to miss the whole time.

Poisonivy don't fret over this! The other guy or his ins. comp. is fighting the ticket to get it reduced. Perfect attendance at school is overrated.:laughing3:

once you get that first absence, it's all down here from there. After that you're like "oh I have a doctors appointment...can we go to the mall after??? I'm already out of school!! please!"

at my school the person with perfect attendance, at the graduation got money and an award, which is the only reason I'd be mad, I don't know if they do that at her son's high school, but it's like 500 dollars.

Double check the stats on when an absence is recorded.
My kid's school records after 1:30, but seemed to have that overlooked on this last perfect attendance.
Of course, court dates are usually in the middle of the day! See if you can have it rescheduled.

Court dates might not count against attendance. I know it's the case with jury duty and employment.
